We have the honor to greet you, as we address you on behalf of the Venezuelan community residing in the United States, members of the “NETWORK OF VENEZUELAN HOUSES AND OTHER VENEZUELAN NGOs”, to respectfully request your expedite action as the guarantors of the functioning of the International Criminal Court (ICC). We urge you to ensure the swift prosecutions of the serious crimes against humanity that have been committed repeatedly and systematically in Venezuela in recent years, and which have exponentially increased in the last few months, without seeing the corresponding measures being taken.
Your Honors, this is not only a matter of punishing past events, which, of course, are crying out for prompt attention, as delayed justice is unjust, but rather the situation is even more serious; these are ongoing crimes that are currently being committed, increasing in both quantity and barbarity since July 28, 2024, when the Venezuelan people, in elections carried out under conditions unjustly favorable to the regime of Nicolás Maduro, Dr. Edmundo Gonzalez Urrutia as President of Venezuela by an approximate ratio of 67 to 30, more than doubling the votes of Nicolás Maduro, the usurper of the presidency. Maduro had publicly announced a “bloodshed” if he did not win the elections. Perhaps It is the only promise fulfilled during his presidency: numerous people have been killed and disappeared, thousands have been wounded and imprisoned, and countless others have been raped and tortured, including hundreds of children. This bloodshed is widely known, condemned by international organizations, by the UN and the OAS, and many State Parties of the ICC, which has also received formal reports and evidence of these crimes.
All of this is taking place in the face of incomprehensible silence and inaction by the Office of the Prosecutor and the International Criminal Court.
We are fully aware of the autonomy of action of the Office of the Prosecutor and the other organs of the ICC, but we are also conscious of your institutional responsibility as the guarantors of the overall functioning of the Court.
In recent years, evidence has been submitted that constitutes reasonable and sufficient grounds to indict Nicolás Maduro and his civilian and military chain of command; there are approximately eleven thousand five hundred (11.500) victims who in 2023 and 2024 have come forward before the Pre-Trial Chamber and the Appeals Chamber.
How much more evidence is needed? How many more deaths, tortures, rapes, beatings, or imprisonments must occur before charges are brought against the alleged perpetrators? Even more is the need for precautionary measures to prevent the continued commission of these crimes, which, as mentioned, are occurring in ever-increasing numbers and with greater cruelty. Preventing and punishing crimes are functions of the ICC, as set forth in both the Preamble and Article I of the Rome Statute.
We know that neither the Statute nor the Rules of Procedure and Evidence establish specific timeframes for the actions we are demanding, but there are reasonable timeframes that equity dictates. For justice to be done, it is unjust to require more blood than the tyrant Nicolás Maduro has already promised.
By respectfully requesting justice, continues investigation of necessary matters, the implementation of precautionary measures to prevent further crimes, and the sanctioning of the alleged criminals, we believe we are representing the unanimous sentiment of more than eight million Venezuelans who have been forced to emigrate, victims of the crime of forced displacement, as defined in the Rome Statute. We also believe we represent the vast majority of our fellow countrymen who remain in the country.
